Bargaining & Negotiation

Driving successful change in complex environments.

We are skilled negotiators known for developing practical strategies that deliver the required results; and we are passionate about maintaining that reputation. We have wide experience in the toughest union environments. Successful change requires the support of those who will be affected by it and a key competency is our ability to develop and communicate strategies that naturally motivate the majority of people to accept the changes proposed. Like any other business improvement project, we consider the level of investment in people that is justified to secure the required changes. We have successfully managed many large projects in both the public and private sectors. Typically, these projects deliver longer-term agreements with significant annual savings, flexible terms of employment, and an absence of strike action and media publicity.

Beyond the employment space, we apply these same skills and principles to the many commercial challenges and disputes we resolve for clients.

Bargaining & Negotiation FAQs

What is business negotiation?

A business negotiation is usually associated with a situation where two businesses are unable to agree on some aspect of the contract, formal or otherwise, between them. While we may like to think parties in business disputes are commercially focused and dispassionate, often that is not the case, and the same emotions associated with union disputes arise.

How do you approach a business negotiation?

Many of the same principles of employment dispute resolution apply to commercial disputes including acknowledging the problem, gathering the necessary information, setting guidelines, keeping emotion out of the discussion and being decisive.

What are key business negotiation skills?

The main skill is to maintain composure, regardless of the provocation. Listen to the respective points of view, ask questions to ensure you understand all points of view, keep an open mind about where the solution may lie, propose a possible solution, test that with the parties and then carefully negotiate to a point where both parties can live with the end result.
